Fly Lanka Pty LtdPvt Ltd,”Fly Lanka ”, ABN 32 654 292 832 is an Australian company which is engaging in the service of Airlines to operate Commercial and Charter flights between Australia and Sri Lanka.
You, “the Passenger” (meaning each of the passengers in your booking – ie. your travelling party— one family, or a group of friends travelling together etc), acknowledge and agree to be bound by these Terms and Conditions. The group contact person in your booking acknowledges and agrees that he or she has the consents and authorisations of each passenger in the booking group to complete this booking on behalf of each passenger, and therefore that all passengers agree to the terms and conditions laid out in these Terms and Conditions.
T&C
The terms and conditions stated in this document (referred to as the “Terms and Conditions”) comprise the entirety of the terms and conditions in connection with this flight. In the event that these Terms and Conditions need to be changed for the operation of this flight, you will receive an updated document containing the new terms and conditions. These Terms and Conditions are governed by the law of Victoria, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
Disclaimer
To the maximum extent permitted by law, we exclude any and all liability for any losses whatsoever that may arise in connection with this flight, and future intended flights, and by agreeing to these terms and conditions, you, “the Passenger”, hereby release Fly Lanka Pty Ltd from any such liability. If a law provides a guarantee or warranty that cannot be excluded, to the extent permitted by law, any liability for a breach of the guarantee or warranty will be limited to either supply of the goods or services again, or payment of the cost of having the same goods and service supplied again, as determined by Fly Lanka Pty Ltd.
You “the Passenger”, acknowledge that in case of deportation, the entire cost towards deportation penalty, return fare and cost of Quarantine will be borne by You “the Passenger”.
Further, in the event you, “the Passenger”, breach these Terms and Conditions, Fly Lanka Pty Ltd will not be liable for any losses whatsoever and you, “the Passenger”, agree to indemnify Fly Lanka Pty Ltd for any losses whatsoever that Fly Lanka Pty Ltd may suffer as a result of your breach of these Terms and Conditions.
You, “the Passenger”, acknowledge and agree that Fly Lanka Pty Ltd has no relationship of employment, trust, agency or partnership with you, “the Passenger”.
If Fly Lanka Pty Ltd provides any assistance to you, “the Passenger”, in connection with this flight, such as transport assistance after reaching the arrival airport and information regarding entry into Sri Lanka , you, “the Passenger” will still remain responsible for such matters.
You, “the Passenger”, agree that you are subject to applicable laws in connection with this flight.
Henceforth, the terms “you” and “Passenger(s)” refer to the person making the booking and each of his/her travelling party.
Eligibility
Only the following people will be permitted to book and fly on this flight, and future flights:
An Sri Lankan or Australian citizen who normally resides in Sri Lanka or Australia ,Dual Citizen of Australia who normally resides in Australia. PR holders might need to get Travel Permit to leave Australia. It is the responsibility of you “the Passenger” to arrange this travel permit from Australian Government.

The Captain of the Airlines and crew can also offload and or deny check-in You, “the Passenger” for any reason beyond Fly Lanka ’s control.
A person who satisfies points 1 and 2 above, and who is very confident that s/he will be able to arrive at the departure airport in plenty of time for the flight (at least 5 hours prior to the scheduled departure time).
It is the sole responsibility of the passenger to ensure his / her eligibility to enter the destination country. Fly Lanka Pty Ltd accepts no liability in this regard.
No refund will be provided to You “the Passenger” if for any reason you are not able to board the aircraft.

The Airline
All intended flights, will be operated with certified Air crews. Fly Lanka Pty Ltd will coordinate the flights and ticketing.
Ticket Price
The entire cost of travel will be borne by You “the Passenger”.
Fly Lanka Pty Ltd are charging people for travel on Economy and Business Class seats. Price is outlined in the shopping cart.
Fly Lanka Pty Ltd reserves the right to vary ticket price at any time without notice and this will not lead to the grounds for any partial/full refund or any compensation to the passengers who already bought the tickets before the price is varied. Every effort will be made to ensure that flights will not be overbooked.
Ticket Payment and Issuing Tickets
Ticket booking will be done through an online portal. This online portal only accepts payment through POLI.The money will be collected into an account held by Fly Lanka Pty Ltd.
At the time of booking total booking value would be deducted. If any balance payment due then it needs to be made within 24 hours after notification through EFT through an Australian bank.
Incase Fly Lanka Pty Ltd is unable to confirm your seat because you have made the payment beyond 24 hrs timeframe after receiving the notification , Fly Lanka Pty Ltd will not be liable to “you the passenger “ for any refund. We will provide you an alternative option or provide you a credit note.
For each booking, Airlines will issue an electronic ticket. The electronic ticket will be emailed approximately 24 to 48 hours prior to flight departure to the email address in the booking. This ticket must be presented at the departure airport.
You should regularly check the email address that you provided in your booking (including any spam/junk folders) for information in connection with this flight.
Passenger list on the flight will not be provided to You “the Passenger”
Restrictions on Ticket Purchase
As there is a limited number of seats available on each flight, you, “the Passenger”, agree to only purchase seats for individuals within your immediate travelling party (e.g. family, group of friends), and who will be ready and able to board the flight in question, including being able to reach the
departure airport on time and having the necessary documents to enter Sri Lanka . Please also see the ‘Eligibility’ section above.
There is a limit of 8 tickets per individual booking.
Tickets are not transferable from one passenger (whose name is on the ticket) to another passenger.
Baggage Allowance
Refer to product description box at the time of purchase. Each PAYING passenger will be allowed their mentioned baggage and one (1) piece of carry on luggage, weighing a maximum of 7kg . This allowance will be STRICTLY enforced at the airport and there will be no ability to purchase an additional luggage allowance. Each INFANT under 2 years will be allowed a maximum of one (1) piece of carry on luggage weighing a maximum of 10 kg for the International Flight. In addition, one (1) pram will be allowed per travelling infant subject to Airline’s approval at the time of check in.
1 bag should not exceed 32kgs. If your baggage allowance is more then 32 kgs then your allowance should be between 2 bags.
You must not include in your luggage any items that are prohibited by any relevant law from being carried onto a plane. You must carry all fragile or valuable items in your carry on luggage.
Infants
Infants under 2 years will require a separate ticket and will be seated with the accompanied adult. No sperate seat is provided to the infant. When completing your booking, infant passenger information is required and a valid passport, or visa and permission to travel, for infants is still mandatory, including in the case where a child has been born in Sri Lanka to Australian parents. It is a requirement of the Flight that there is a minimum of one travelling adult for each travelling infant under 2 years.
Given the unprecedented global changes that have resulted from the Covid-19 pandemic, infants under 4 weeks are not permitted on this flight without written authorisation from Fly Lanka Pty Ltd prior to booking, with such written authorisation to be at Fly Lanka ’s sole discretion.
Children Under 18 Years
Given the unprecedented global changes that have resulted from the Covid-19 pandemic, children under 18 years must be accompanied on the flight by their parent or guardian.
Pregnant Women
Given the unprecedented global changes that have resulted from the Covid-19 pandemic, pregnant women who are more than 28 weeks pregnant are not permitted on this flight unless they satisfy the flying requirements of Airlines.
The Flight
You and your luggage may be subject to inspection and disinfection procedures.
You, “the Passenger”, agree to follow any and all specific directions given to you by the ground staff, flight crew and officials at the departure and arrival airports and during the flight.
We reserve all rights to refuse the boarding of any Passenger or remove any Passenger from the flight, without any liability for losses whatsoever, if Fly Lanka Pty Ltd consider it is in the best interests of the flight’s operation and the other Passengers and flight crew.
At the departure and arrival airports and during the flight You “the Passenger” are strongly encouraged to wear your face mask over your mouth and nose and practice 1.5 metre social distancing to the maximum extent possible.
Fly Lanka Pty Ltd reserves the right to use your photographs clicked at the airport by our representatives during your flight departure for marketing purpose on our website and various Social Media platforms.
Visas and Immigration
You “the Passenger” is taking responsibility that you are fully eligible to enter or transit the country for which you are purchasing a ticket on these special flights .Fly Lanka Pty Ltd accepts no liability in this regard.
Arriving into Sri Lanka
In making this booking You “the Passenger” acknowledge and agree that you are eligible to enter Sri Lanka under the current border arrangements, and that you have the correct and necessary documents for entry. We are unable to give you any advice in relation to your eligibility to enter Sri Lanka and any information provided in these Terms and Conditions has not been verified by an Australian and Sri Lankan government official and is provided to the best of Fly Lanka’s knowledge and belief.
Prior to booking a ticket, all passengers must carefully consider the information in the ‘Eligibility’ and the ‘Visa and Immigration’ sections of these Terms and Conditions in order to ascertain whether you are indeed eligible to leave Australia and enter Sri Lanka at this time. If you are ineligible to leave Australia or enter Sri Lanka at this time, and still purchase a ticket, you will not be allowed to board the flight and the cost of your ticket will not be refunded under any circumstances.
Fly Lanka ’s Terms and Conditions on Booking, Ticket Changes and Ticket Cancellations/Refunds
To assist with a smooth passage through both Australian and Sri Lankan customs it is critical that you provide the correct information on the booking form. Names (surname and given names) must match those provided on your passport. If a name field in your passport is blank please write “LNU”. If you are an Australian passport holder you must ensure that the visa type and number are provided.
This and all other information you provide on the booking form (for example, address for stay in Sri Lanka ) must be up-to-date and valid. Failure to comply may result in the cancellation of your booking, delays transiting through Australia or denial of entry to Sri Lanka upon arrival.
It is your responsibility to provide all details on the booking form correctly and Fly Lanka Pty Ltd will not be liable for any losses whatsoever that may occur due to incorrect information being supplied for passengers.
It is the responsibility of You ”the Passenger” to ensure that transportation to their departure point is available before booking a flight. Cancellation or flight change requests based on transportation unavailability will still result in the application of the applicable policy.
Any cancellations or no-shows by a ticket holder, for any reason, will result in the loss of all payments. This includes the situation where a ticket-holder(s) cannot board a flight due to reasons beyond their control, such as being delayed in reaching the airport or being denied boarding for whatever reason.
In case a flight does not operate on or around the scheduled date due to reasons within our control, We will provide you alternative options.
Fly Lanka Pty Ltd is not liable to You “the Passenger” for any refund in this case. Fly Lanka Pty Ltd will not be liable for any other claim including the negligence or fault, if any, of ours or of a third party.
In relation to the Flight, date ,time of departure or arrival, the city of departure or the city of arrival, can change for reasons beyond our control and if it happens this will not be the grounds for seeking refund.
No refund would be permitted based on such changes.
Changes and Cancellation
Any cancellations by Airlines before departure, for any reason, will result in application of Airlines cancellation Policy and FLY LANKA PTY LTD will apply administrative charges.
Minimum AUD 300.00 change fee will apply as administrative fees of Fly Lanka Pty Ltd incase Changes/Cancellation are permitted.
FLY LANKA PTY LTD will not be liable for any other claim including the negligence or fault, if any, of ours or of a third party.
It is customer’s responsibility to reconfirm the itinerary 2 days prior to departure. Domestic Ticket :
Domestic flights in Australia are subject to change and Fly Lanka Pty Ltd will not be liable to refund or provide any compensation to “You the passenger” in case of change of Domestic flights.
PASSENGERS WITH MEDICAL CONDITIONS
The Airlines will ask You “the passenger” to declare any serious medical conditions at the time of booking will reserve the right to refuse ticket issuance or deny boarding at the airport if your health cannot be appropriately managed on this flight. Fly Lanka Pty Ltd is not liable to any refund to “the passenger” in such cases.
Due to such unprecedented times , In unfortunate cases where passenger is unable to board the flight due to Death of the traveler/family member before the departure or during the flight, Fly Lanka Pty Ltd will not be liable to any refund to the passenger or to the family.
Wheelchair :
Wheelchair ,a special service which is requested to the Airline before the travel when you make the booking online .This service is subject to availability. Depending on the availability Airline provides you the wheelchair and under any circumstances cannot be guaranteed. Fly Lanka Pty Ltd is not liable to any refund or compensation to you “the passenger” in case Wheelchair is not available at the time of Check in.
Meals :
Standard Veg/ Non Veg meals will be provided to all the travellers by the Airline and can include Dairy, Gluten and nuts. Fly Lanka Pty Ltd is not be liable to you for any Loss, expense, or other damage should you , for any reason, do not like or consume the meals provided during the flight.
Quarantine

Passengers might have to undertake to directly bear the entire cost towards Quarantine charges at the time of arrival at the destination.

Fly Lanka Pty Ltd provides any assistance to you, “the Passenger”, in connection with your flight, such as transit rules and information regarding entry into Australia, you, “the Passenger” will still remain responsible for such matters.
You, “the Passenger”, acknowledge and agree that you have booked a flight to Australia , and accept that there may be inherent risks involved with these flights and we are unable to make guarantees in relation to immigration policies, cancellations by airlines and Travel Ban from Government in Australia, particularly given the unprecedented global changes that have resulted from the Covid-19 pandemic .
You “the Passenger” acknowledge and agree that due to any reasons if there is a travel ban is your arrival city while in transit while transit then Fly Lanka Pty Ltdis not responsible, and you agree to pay for any additional cost to reach the final destination.
You “the Passenger”, acknowledge that in case of deportation, the entire cost towards deportation penalty, return fare and cost of Quarantine will be borne by You “the Passenger”.
You “the Passenger” is taking responsibility that you are fully eligible to enter or transit the country for which you are purchasing a ticket. Fly Lanka Pty Ltd accepts no liability in this.
Fly Lanka ’s Terms and Conditions on Booking, Ticket Changes and Ticket Cancellations/Refunds

Fly Lanka Pty Ltd is not liable to You “the Passenger” for any refund in this case. Fly Lanka Pty Ltd will not be liable for any other claim including the negligence or fault, if any, of ours or of a third party.
In the situation where a ticket-holder(s) is denied boarding/Check-in for whatever reason, will result in the loss of all payments.
Any cancellations by Airlines before departure, for any reason, will result in application of Airlines cancellation Policy and Fly Lanka Pty Ltd will apply administrative charges.
In relation to the Flight, date, time of departure or arrival, the city of departure or the city of arrival, can change for reasons beyond our control and if it happens this will not be the grounds for seeking refund.
No refund would be permitted based on such changes.
Once the ticket is issued then ticket becomes non changeable and non-refundable. Minimum AUD 300.00 change fee will apply as administrative fees of Fly Lanka . .
